Terms of Service

1. Acceptance of Terms

By accessing or using the PrideDMR Network ("the Network"), you agree to be bound by these Terms of Service and our Code of Conduct. If you do not agree to these terms, please do not use the Network.

2. Amateur Radio License Requirement

Use of this Network requires a valid amateur radio license in your jurisdiction. You are solely responsible for compliance with all applicable amateur radio regulations, including but not limited to FCC Part 97 (United States) or equivalent regulations in your country.

3. Network Purpose

PrideDMR is a community-operated DMR network designed to provide a safe, inclusive space for LGBTQIA+ amateur radio operators and allies. This is a volunteer-run, non-commercial service.

4. User Account Responsibilities

  • You must provide accurate information when registering
  • Your DMR ID must be valid and assigned to your amateur radio callsign
  • You are responsible for maintaining the security of your hotspot credentials
  • You must not share your account or credentials with others
  • You must notify us immediately of any unauthorized use of your account

5. Acceptable Use

You agree to:

  • Comply with all amateur radio regulations in your jurisdiction
  • Follow our Code of Conduct at all times
  • Properly identify your transmissions as required by law
  • Use appropriate language and behavior on all talkgroups
  • Respect other users and their right to use the Network

6. Prohibited Activities

The following activities are strictly prohibited:

  • Hate speech, harassment, or discrimination based on sexual orientation, gender identity, race, religion, disability, or any protected characteristic
  • Transmitting encrypted or obscured communications (except where permitted by amateur radio regulations)
  • Commercial use or advertising
  • Transmitting music, copyrighted material, or other content prohibited by amateur radio regulations
  • Attempting to disrupt, damage, or gain unauthorized access to the Network
  • Impersonating other users or network administrators
  • Kerchunking, jamming, or otherwise interfering with legitimate communications

7. Content and Transmissions

All transmissions on the Network must comply with amateur radio regulations. We do not monitor transmissions, but violations reported to us will be investigated. You are solely responsible for the content of your transmissions.

8. Network Availability

We strive to maintain high availability, but the Network is provided "as is" without guarantees:

  • We do not guarantee uninterrupted access
  • Maintenance may occur without prior notice
  • We may modify or discontinue features at any time
  • Coverage and audio quality may vary

9. Account Suspension and Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms of Service or Code of Conduct
  • Violate amateur radio regulations
  • Engage in abusive behavior toward other users
  • Pose a security risk to the Network

Serious violations may result in immediate termination without warning. We will make reasonable efforts to contact users regarding minor violations before suspension.

10. Privacy

We collect minimal information necessary to operate the Network:

  • Username, email, and DMR ID for account management
  • Hotspot connection logs for network diagnostics
  • Transmission metadata (timestamps, talkgroups) for network statistics

We do not record audio content. We will not share your personal information except as required by law.

11. Limitation of Liability

The Network is provided free of charge on a volunteer basis. To the maximum extent permitted by law:

  • We provide no warranties, express or implied
  • We are not liable for any damages arising from use of the Network
  • We are not responsible for the conduct of users
  • You use the Network at your own risk

12. Indemnification

You agree to indemnify and hold harmless PrideDMR Network, its operators, and volunteers from any claims, damages, or expenses arising from your use of the Network or violation of these terms.

13. Changes to Terms

We may update these Terms of Service at any time. Continued use of the Network after changes constitutes acceptance of the updated terms. Major changes will be announced on the Network.

14. Governing Law

These terms are governed by the laws of the United States and the state where the Network is operated, without regard to conflict of law principles.
